Pavlenko & Poberezhnyuk, Law group won the case of Bank Daniel

On 4 February, 2010 the Kyiv Appeal Economic Court satisfied appeal of the Opened Joined Stock Company the “Commercial bank “Daniel'”, in relation to abolition of the Kyiv Economic court’s decision on satisfaction of the claim of a private entrepreneur “Svit” on termination of the guarantee and mortgage contract.

In 2007 the bank “Daniel'” provided a credit according to which private entrepreneur “Svit” acted as a property guarantor and mortgagor. In November, 2009 private entrepreneur “Svit” appealed to the court in regard to termination of guarantee and mortgage contract with the Bank “Daniel'”, and on 8 December, 2009 the Economic court of Kyiv satisfied the requirements of the applicant. However the Kyiv Appeal Economic Court abolished this decision.

Attorney-at-law Konstantin Dovbnya and associate Anna Kombikova under the supervision of partner Larysa Poberezhnyuk represented the interests of the Bank “Daniel” in this dispute.
