Pavlenko & Poberezhnyuk Law Group supports the initiatives to simplify the land right acquisition procedure

Pavlenko & Poberezhnyuk Law Group supports the legislatives initiatives by the Confederation of Builders of Ukraine (CBU) aimed at simplification of the procedure and shortening terms of land title acquisition, provision of obsolete housing complex reconstruction, and establishing procedures for self-regulating organizations’ activities.
Notably, Pavlenko & Poberezhnyuk Law Group is a member of the work team for developing a draft Law On amendments to Certain Laws of Ukraine Regarding Simplification and Shortening Terms of Land Title Acquisition initiated by the CBU.
“The Confederation of Builders of Ukraine is carrying-out extensive activity in building sector reforming. In this respect it should be noted that the regulations initiated and developed by the Confederation may be deemed advanced, politically-free and efficient in this sector problem solution,” Larisa Poberezhnyuk, partner with Pavlenko & Poberezhnyuk Law Group noted.
As Ms Poberezhnyuk further explained, one of the major laws adopted in 2011 was the Law of Ukraine On Regulation of the Town-Planning Activity, initiated and developed by the Confederation. The Law significantly simplifies the licensing procedure and globally solves the random construction problem.
Alongside with this, the Law On amendments to Certain Laws of Ukraine Regarding the Simplification of the Procedure and Shortening Terms of the Land Title Acquisition particularly provides for the tacit consent principle to be introduced during the local body permission obtaining procedure, which will also allow to reduce the land allocation period by third - from the former 540 days to 130 days now.
Besides, the project entitles the tenant to sell the right to the land plot or a part of it.
At the same time, according to Leo Partskhaladze, the CBU’s Board of Directors Chairman, for further effective renewal of town-planning activity in Ukraine this sector legislation requires further enhancements.
“We have carried-out tremendous work for the last 9 months. There have been a lot of legislative initiatives made. We are determined to enhance the image of the Confederation of Builders of Ukraine mainly as the reforms implementing organization”, Mr Partskhaladze recently affirmed at the Confederation’s Board of Directors extended meeting.
Mr Partskhaladze finally specified the significance of educating citizens on exercising their rights, and pointed out the requirement to provide control over the Law implementation while promptly responding to any cases of its violation.
Notably, according to Mr Parskhaladze, the local authorities tend to elude the Law On Regulation of Town-Panning Activity.
